Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you (and the business you represent) and Dash Funnels, operated by VIS Mountain. They govern your access to and use of the Dash Funnels software application, including the web app at app.dashfunnels.com, the mobile apps, the AI Agent, and any related managed services (together, the “App” or “Platform”). By creating an account, starting a free trial, or using the App, you agree to these Terms. If you don’t agree, don’t use the App.

The App / the service

Dash Funnels is a software-as-a-service (SaaS) platform that brings funnels, CRM, calendar and booking, email/SMS, reviews, payments, analytics, and an AI Agent into one login, with optional done-for-you managed services. Features available to you depend on your plan. We may add, change, or remove features over time.

Eligibility & accounts

You must be at least 18 and able to form a binding contract. You access the App by signing in at app.dashfunnels.com. You’re responsible for your account credentials, for all activity under your account and any sub-accounts or team members you add, for keeping your login secure, and for the accuracy of the information you provide. Notify us promptly of any unauthorized use.

Your license to use the App

Subject to these Terms and your active plan, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the App for your own business purposes during your subscription. You may not resell, sublicense, copy, reverse-engineer, scrape, or build a competing product from the App, or exceed the limits of your plan (e.g., users, contacts, sending volume).

Free trial

We may offer a 30-day free trial with no credit card required, provided after you book and complete an onboarding/demo. Trials are for evaluation, may have feature or usage limits, and may be changed or ended at our discretion. Unless you tell us otherwise, at the end of a trial you may choose a paid plan to keep your account and data active.

Subscriptions, billing & cancellation

Paid plans are billed in advance and renew automatically (monthly unless stated otherwise) until cancelled. You can cancel anytime from your account or by contacting us; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by law. Usage-based charges (e.g., SMS, email, AI, phone, or other consumption) may apply on top of plan fees. We may change pricing with notice.

Your data & content

You own the data, contacts, and content you put into the App (“Your Data”). You grant us a license to host, process, and transmit Your Data solely to provide and improve the App and as described in our Privacy Policy. You are responsible for the accuracy and legality of Your Data and for having the rights and consents needed to use it. For protected health information, our BAA & HIPAA Notice applies.

Messaging & communications compliance

If you send SMS, email, or calls through the App, you must have lawful consent from your recipients, honor opt-outs and do-not-contact requests, and comply with all applicable laws and carrier rules (including TCPA, CAN-SPAM, and A2P 10DLC registration where required). You are solely responsible for your campaigns and contacts. We may throttle or suspend sending to protect deliverability and compliance.

Acceptable use

Your use of the App is subject to our Acceptable Use Policy. We may suspend or terminate accounts that violate it.

AI features

The App includes AI features, including the AI Agent. AI assists and is supervised by people, but it can make mistakes and does not provide professional, medical, legal, or financial advice. Your use of AI is also governed by our AI Policy.

Third-party services & integrations

The App connects to third-party services (e.g., payments, calendars, ads, messaging) you choose to enable. Your use of those services is governed by their own terms, and we’re not responsible for them.

Availability & support

We work to keep the App available and reliable but do not guarantee uninterrupted or error-free service, and we may perform maintenance. Support is provided per your plan and our Support page.

Suspension & termination

We may suspend or terminate your access for non-payment, violation of these Terms or the Acceptable Use Policy, legal/security reasons, or risk to the App or others. You may stop using the App and cancel at any time. On termination, your right to use the App ends; we will make Your Data available for export for a reasonable period, after which it may be deleted.

Intellectual property

The App, its software, and our trademarks are owned by us and our licensors. These Terms grant you no ownership in the App. You retain ownership of Your Data.

No guarantees

We work hard to deliver results, but we do not guarantee specific revenue, lead volume, rankings, or outcomes. The App and services are provided “as is” and “as available” without warranties of any kind to the maximum extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, Dash Funnels and VIS Mountain are not liable for indirect, incidental, special, or consequential damages, or lost profits or data. Our total liability for any claim is limited to the amounts you paid for the App in the 12 months before the claim.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of Your Data, your contacts and campaigns, your use of the App, or your violation of these Terms or applicable law.

Governing law & changes

These Terms are governed by the laws of the United States and the state in which VIS Mountain operates, without regard to conflict-of-laws rules. We may update these Terms; material changes will be posted here with a new date, and continued use of the App means you accept them.
